This bill restricts presidential power to impose tariffs and trade restrictions by requiring congressional approval for most national security-based tariffs and establishing new oversight of the U.S. Trade Representative's authority. Under the bill, when the President wants to impose national security tariffs, they must submit the proposal to Congress within 15 days, provide reports from the Defense Department and International Trade Commission, consult with four key congressional committees, and obtain approval through a joint resolution before the tariffs can take effect. The bill does include a narrow exception allowing the President to impose tariffs for up to 120 days without congressional approval in genuine emergencies involving threats to national security, loss of life, or public health. Similarly, the bill requires the Trade Representative to notify Congress and allow a 60-day review period before imposing tariffs under trade dispute authority, during which Congress can block the action through a disapproval resolution. The legislation aims to restore congressional authority over trade policy, which lawmakers argue has shifted too heavily toward the executive branch in recent decades.
