S. 321
S. 321, the Decoupling America's Artificial Intelligence Capabilities from China Act of 2025, aims to restrict U.S.-China AI cooperation by prohibiting American persons and entities from developing, exporting, or sharing artificial intelligence technology with China or Chinese entities of concern, effective 180 days after enactment. The bill broadly defines AI to include machine learning and autonomous systems, and covers all U.S. actors including corporations, universities, government agencies, and research facilities. Violations carry steep penalties, including criminal fines up to $100 million for organizations and $1 million for individuals, license and contract forfeiture, five-year bans from federal assistance, and potential deportation for violators. The bill also authorizes the President to prohibit U.S. investment in Chinese AI companies involved in military applications or human rights abuses, enforced through existing export control laws and emergency economic powers.
