Referred to the Committee on Ways and Means, and in addition to the Committee on Education and Workforce, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.
The RETAIN Act creates a refundable tax credit to help retain educators in early childhood programs, elementary schools, and secondary schools. Eligible recipients include early childhood educators, teachers, paraprofessionals, school leaders, and school-based mental health providers working at high-poverty schools or quality early childhood programs. The credit amounts range from $5,800 to $11,600 per year depending on years of continuous service, with the highest credit ($11,600) available to educators in their tenth year of service, then stepping down for longer tenures. The credit applies to tax years beginning after December 31, 2025, and will be adjusted for inflation annually starting in 2026. The legislation also requires schools and early childhood programs not to reduce educator compensation or loan forgiveness programs due to the credit, ensuring it supplements rather than replaces existing pay, and directs federal agencies to track teacher and early childhood educator salary data by region and program type.
