The FAIR Leave Act would modify the Family and Medical Leave Act by removing restrictions that currently limit leave for married couples who work for the same employer. Under current law, Section 102(f) of the Family and Medical Leave Act caps the total amount of leave that spouses employed by the same company can take for certain qualifying reasons—essentially requiring couples to share their available leave time. This bill would repeal that cap, allowing each spouse to take their full allotment of leave independently. The legislation affects married employees at the same workplace and would give them greater flexibility in managing family and medical leave without having to divide their entitlements with their spouse. The bill was introduced in December 2025 and referred to the Senate Committee on Health, Education, Labor, and Pensions for consideration.
