S. 3495, the Artificial Intelligence Scam Prevention Act, strengthens consumer protections against AI-powered fraud by requiring companies using artificial intelligence to impersonate humans in calls, text messages, or video conferences to disclose that fact upfront. The bill expands existing telemarketing and fraud laws to cover text messages, video calls, and AI-generated deepfakes, closing loopholes that scammers currently exploit through these newer communication channels. The Federal Trade Commission will enhance public awareness by improving its scam complaint portal, targeting educational outreach to seniors and law enforcement, and establishing a five-year advisory group with federal officials and industry representatives to develop best practices for retailers and financial services companies. The FTC must also provide annual reports to Congress on AI-enabled scams and voice cloning fraud, while the Federal Communications Commission has 270 days to update its rules for better robocall and misleading caller ID reporting.
