The Patriots Over Politics Act would allow military members who were separated from the Armed Forces between August 2021 and January 2023 specifically because they refused a COVID-19 vaccination to transfer their veterans' education benefits to their dependents. Under current law, these service members generally cannot pass these education benefits to family members, but this bill creates a 90-day window for them to do so. The transferred benefits would typically only become available to children after the original service member completed at least six years of active service. The legislation applies to members who were either involuntarily discharged or voluntarily separated solely because of their vaccine refusal and would be administered by the Department of Veterans Affairs.
