H.R. 3669
This bill modifies the federal REAL ID Act to give individual states the flexibility to decide whether driver's licenses and state identification cards must include a gender or sex field. If a state chooses to include gender information, the bill requires that people be able to select their designation without needing additional documentation like a doctor's note, and states must offer an "unspecified or other" option beyond just male or female. The legislation, introduced in June 2025, essentially removes the current federal requirement that licenses include gender information and allows each state to set its own policy on this matter. The bill does not include specific funding allocations or implementation timelines, instead leaving implementation details to individual states.
