H.R. 3792
The Kids Information Data Security Act would prohibit healthcare providers who participate in Medicare, Medicaid, and CHIP from requesting information about minors' gender identity or sexual preference on intake forms or other data collection documents, unless that information is clinically necessary for diagnosing, treating, or preventing a specific medical condition. The bill applies to any healthcare provider receiving federal funding through these programs and takes effect 180 days after enactment. The legislation also requires the Secretary of Health and Human Services to establish a reporting mechanism within 180 days so patients can report violations of this prohibition. No specific funding is allocated in the bill; rather, it establishes penalties for non-compliance by allowing providers who violate the rule to be excluded from Medicare and state health care programs.
