Referred to the Committee on Energy and Commerce, and in addition to the Committees on Ways and Means, and Education and Workforce, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.
This bill allows parents to choose which parent's health insurance plan will be the primary coverage for their newborn child when both parents have separate health insurance policies or group health plans at the time of birth. To make this choice, both parents must jointly submit a notification to their insurance issuer within 60 days of the child's birth. The primary coverage designation continues until both parents agree to change it or until one parent loses their own coverage. The bill applies only when both parents each have separate insurance policies that would cover the child, and parents cannot designate multiple plans as primary simultaneously. These new rules take effect for children born on January 1, 2026 and forward, and the bill amends federal health insurance law, employee benefits law, and tax code to implement this change.
