The WINGS Act authorizes the Secretary of Agriculture to transfer ownership of aircraft and aircraft parts to state and local firefighting agencies that have borrowed them through the Federal Excess Personal Property program. Eligible agencies must have continuously possessed an aircraft for at least 10 years or aircraft parts for at least 5 years and must be in good standing, meaning they have complied with all program requirements, maintained proper records, and not misused the equipment. Upon transfer, the federal government relinquishes all ownership rights, though the Secretary can impose conditions lasting up to 5 years requiring the equipment to be used for public safety purposes like wildfire suppression or firefighting training. The Secretary must issue regulations within 18 months establishing criteria for determining good standing, inventory management standards, and application procedures, and must make a decision on any transfer application within 180 days of receiving a complete application.
