Currently, there is confusion about whether annuity supplements—additional payments made to certain retirees—should be included in the division of retirement benefits ordered by a court. The legislation requires that court decrees and orders must expressly state whether annuity supplements are included in or excluded from the division of retirement benefits. For people who were already retired when this law takes effect, the Office of Personnel Management will issue one-time payments to those who lost money because their annuity supplements were retroactively included in court-ordered divisions, while also waiving any overpayments that former spouses may have received as a result of the previous confusion. The bill applies to all new annuity supplement payments beginning on the date the law is enacted.
