Referred to the Committee on Energy and Commerce, and in addition to the Committee on the Judiciary, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.
The Cooper Davis and Devin Norring Act requires internet and email service providers to report suspected illegal drug activity involving fentanyl, methamphetamine, counterfeit substances, and unauthorized prescription medications to the Attorney General within 60 days of discovery, with criminal fines up to $190,000 for first violations and $380,000 for repeat offenses. The bill includes important privacy safeguards, prohibiting providers from being required to monitor or search communications and allowing them to maintain end-to-end encryption, while law enforcement must keep reports confidential and is barred from submitting false reports. Broadband and text messaging providers are exempt from these reporting requirements. The Attorney General must publish annual reports on the volume of reports, investigation outcomes, and patterns, and providers cannot face penalties for failing to investigate beyond their discovery of evidence.
