The KIDS Act would prohibit the Department of Homeland Security from detaining children, individuals with cognitive disabilities, or primary caregivers of such individuals. The bill also restricts immigration enforcement actions within 1,000 feet of sensitive locations, which include schools, hospitals, places of worship, courthouses, polling places, shelters, and other facilities providing services to vulnerable populations. These restrictions would not apply to enforcement actions conducted under criminal arrest or search warrants issued by a court. If the department violates these restrictions, information obtained during the enforcement action cannot be used in removal proceedings, and any person detained in violation of the law must be released. The bill requires the department to report any detention of children or individuals with cognitive disabilities to Congress within 24 hours and to prioritize releasing them to parents, guardians, designated caregivers, or child protective services agencies.
