Beyond federal programs, the legislation would also prohibit the government from restricting abortion coverage in state, local, or private insurance plans, and it repeals existing Affordable Care Act provisions that limit abortion coverage funding. With over 240 cosponsors, the bill asserts Congress's constitutional authority to enact this legislation through the Commerce Clause, Taxing and Spending Clause, and Fourteenth Amendment, and it explicitly states it supersedes conflicting federal law and is not subject to religious freedom protections.
