This bill amends the Small Business Act to help small businesses with government construction contracts get paid more quickly when the terms of their contract are changed by a federal agency. When a contracting officer orders a change to a construction project without the small business's agreement, the business can request an equitable adjustment to cover the added costs. Under this bill, the agency must provide the business with an interim partial payment equal to at least 50 percent of the business's estimated additional costs while the final adjustment amount is being worked out. Small businesses receiving these interim payments must pass along the appropriate share to their subcontractors, including lower-tier subcontractors, based on the subcontractors' own increased costs. The Small Business Administration has 90 days after the law takes effect to issue formal rules implementing these requirements.
