The Tax Relief for Innocent Spouses Act would allow the Tax Court and other courts to conduct a full independent review of innocent spouse relief cases. Currently, court reviews of these cases are limited by specific procedural requirements. Under this bill, courts would have broader authority to examine innocent spouse claims from scratch, rather than being restricted to reviewing only whether the Internal Revenue Service properly applied existing rules. The legislation applies to all innocent spouse petitions and requests filed or pending on or after the date the bill becomes law. This change aims to give taxpayers who believe they were wrongly held responsible for a spouse's tax debts greater opportunity to have their cases thoroughly reviewed by judges.
