The NO CHEATS Act requires U.S. Customs and Border Protection to collect tariff duties and interest on solar panel imports that were improperly granted duty-free status under a temporary moratorium that ran from June 2022 to June 2024. The bill targets crystalline silicon photovoltaic cells that should have been subject to existing antidumping and countervailing duties but were admitted without those duties during the exemption period. Importers of record will have 90 days from the bill's enactment to receive bills for the owed duties plus interest, calculated from the original entry date until full payment. The law requires Customs to publish and regularly update a public list showing which importers received bills, the amounts owed, and payment status. All collected duties and interest will go into the general Treasury fund, and importers retain their right to challenge assessments through administrative or judicial review.
