The Federal Trade Commission will enforce the law, treating violations as unfair or deceptive practices with associated penalties, while state attorneys general can also sue on behalf of their residents. The legislation takes effect 90 days after enactment and does not preempt existing child privacy protections under the Children's Online Privacy Protection Act.
