An independent, Senate-confirmed Review Board with subpoena authority will oversee agency compliance and make final decisions on whether records can be withheld, applying strict standards that generally require postponement to be based on clear and convincing evidence of grave harm to national security, intelligence sources, or foreign relations. All missing personnel records must be fully disclosed within 10 years unless the President certifies extraordinary circumstances, and agencies are prohibited from destroying or altering these documents, with government officials subject to penalties for failing to conduct thorough searches. The Act supersedes most other laws in requiring disclosure while preserving existing Freedom of Information Act rights and allowing voluntary disclosure by the President, agencies, or Congress beyond what the Act requires.
