The Births in Custody Reporting Act requires states to collect and report detailed information to the Attorney General about pregnant women and women who give birth while in custody of law enforcement agencies, including jails, prisons, and other correctional facilities. States must submit quarterly reports containing anonymized data on the number of pregnant inmates, their race and ethnicity, whether they received timely pregnancy tests and prenatal care, pregnancy outcomes, use of restraints during pregnancy and labor, postpartum care, and placement in restrictive housing. States have 120 days from the bill's enactment to begin complying with reporting requirements, with a possible 120-day extension for good-faith efforts, and can face a reduction of up to 10 percent in federal law enforcement funding for noncompliance. The Attorney General must publish the reports publicly and conduct a study within two years to analyze the data and identify ways to improve treatment of pregnant and postpartum inmates in custody.
