The bill directs the Commerce Department to develop performance metrics measuring the AI hardware capabilities of adversary nations and to set annual export limits ensuring that hostile countries cannot accumulate chip technology that approaches American capabilities. Within 365 days of the law's enactment, and then annually, the government must assess adversary AI hardware stocks and implement license denial policies for exports that would allow foreign entities to access chips exceeding specified performance thresholds or that would cause total adversary AI hardware to exceed five percent of what the United States possesses. Companies seeking to export AI chips under this framework must certify they are not diverting U.S. production capacity, that foreign shipments do not exceed fifty percent of comparable U.S. shipments, that items serve only civilian purposes, and that independent testing confirms the chips' technical specifications.
