The Ensuring Excellence in Mental Health Act expands mental health and substance abuse treatment services by modernizing how certified community behavioral health clinics operate and are funded. Beginning January 1, 2026, the bill implements a new Medicare and Medicaid payment system for these clinics, allows them flexibility in how they deliver services, and makes accreditation optional under Medicaid (though states may require it). The legislation provides $552.5 million in annual federal grants through 2030 to support clinic operations, staffing, and technology, along with $8 million yearly for technical assistance and $51 million annually for a national data collection system to track clinic performance. To encourage clinicians to work in underserved areas, the bill extends federal liability protections to behavioral health clinic staff, shielding them from personal lawsuits similar to other federally-funded healthcare providers, and establishes an accreditation framework with federal oversight to ensure quality standards.
