The bill also mandates that an independent third party conduct environmental impact analysis funded by the developer, and restricts the use of non-disclosure agreements during the development process, particularly with government entities. The Federal Trade Commission will enforce these requirements and can treat violations as unfair or deceptive business practices under existing FTC law. The bill applies to companies engaged in interstate or foreign commerce, including those that transmit data across state lines or participate in interstate markets for computing infrastructure.
