This bill makes technical corrections to the 2022 Camp Lejeune Justice Act, which allows people exposed to contaminated water at the Marine Corps base to sue the federal government for health damages. The revisions expand who can claim compensation by including "latent or potential harm" (illnesses that may develop in the future, not just current diseases) and clarify that plaintiffs need only show exposure to contaminated water for 30 days at any point. The bill also adjusts how cases are handled in court, allowing them to be tried in federal district courts within the fourth judicial circuit (rather than only North Carolina) and establishes attorney fee caps at 20 percent for settlements before lawsuits are filed and 25 percent afterward. Additionally, it modifies rules for offsetting payments so that settlements reached before a lawsuit begins won't be reduced by veterans benefits or Medicare/Medicaid payments, while those after a lawsuit is filed may be offset. The changes take effect retroactively to August 10, 2022, and apply to all pending and future claims under the original Camp Lejeune law.
