The Governors' Right to Inspect Act of 2026 authorizes state governors to conduct unannounced health and safety inspections of immigration detention facilities located within their states, including those operated by private contractors. Governors and their designated state officials would have access to all detainee housing areas, the ability to speak privately with detainees, and permission to review and photograph facility records and conditions related to sanitation, medical care, food quality, and safety systems. The bill specifically prohibits governors from interfering with immigration enforcement operations, custody decisions, or removal proceedings, and requires designated state officials to provide 24 hours' notice before inspections while governors may inspect without notice. Following inspections, governors may submit reports to Congress documenting health and safety deficiencies, with the Department of Homeland Security required to respond within 60 days, and all reports made publicly available online. The legislation takes effect 180 days after enactment and authorizes unspecified federal funding to establish security protocols and maintain a public reporting system.
