The Fair Telehealth Billing Act of 2026 prohibits health care providers and facilities from charging separate facility fees when they bill independently for telehealth services. Under current practice, patients using telehealth sometimes face both a charge for the doctor's professional services and an additional facility fee, even though no physical facility is being used. This bill eliminates that practice by preventing providers from collecting both charges simultaneously for remote care. The legislation applies to health plans regulated under federal employee benefits law and takes effect on January 1, 2028. Providers who violate this rule face civil penalties of up to $10,000 per violation, enforced by the Secretary of Labor.
