This bill would ban cosmetics manufacturers from intentionally adding PFAS chemicals (perfluoroalkyl and polyfluoroalkyl substances) to their products. PFAS are a class of fluorinated chemicals commonly used in cosmetics for water resistance and other functional properties, but they persist in the environment and human bodies, raising health concerns. The ban applies to any PFAS intentionally added by manufacturers or suppliers to cosmetic ingredients, raw materials, products, or packaging that serve a functional purpose, as well as intentional breakdown products of added chemicals. The prohibition takes effect on January 1, 2027, giving cosmetics companies approximately six months to reformulate products and comply with the new requirement. The legislation amends the Federal Food, Drug, and Cosmetic Act to classify cosmetics containing intentionally added PFAS as adulterated products, which would be prohibited from distribution.
