The Buying Faster than the Enemy Act aims to streamline and accelerate Department of Defense procurement by expanding the use of commercial products and services. It also reduces red tape by limiting the number of contract requirements that must flow down to subcontractors, consolidating them into single clauses for commercial and noncommercial purchases alike, and increases advance payment authority from 15 to 30 percent of contract value. Additionally, the legislation establishes a presumption that military purchases should be treated as commercial unless a contracting officer provides written justification to the contrary. The Defense Department has 120 days to implement most changes and 180 days to update acquisition regulations, affecting defense contractors of all sizes but particularly benefiting companies selling commercial products to the military.
