This bill would withhold federal highway funding from states that do not adopt strict voter registration requirements based on citizenship proof. Beginning in fiscal year 2027, states would lose 10 percent of their apportioned surface transportation funds if they fail to enact laws requiring voters to present documentary evidence of U.S. citizenship, such as a passport, REAL ID-compliant identification, birth certificate, or military records. The penalty would increase by an additional 5 percent each year a state remains non-compliant. States would also be required to establish alternative processes for applicants unable to meet these requirements, maintain ongoing programs to identify and remove noncitizens from voter rolls, and create criminal penalties for election officials who register non-citizens. The bill additionally permits private lawsuits against election officials who fail to enforce these citizenship requirements.
