Rep. Gomez Demands Accountability and Transparency for Man Shot by ICE in Austin, TX

WASHINGTON, D.C. — U.S. Representative Jimmy Gomez (CA-34) and over 100 Members of Congress demanded that ICE immediately release Wilber Rafael Garces Perez from detention to allow him to receive medical treatment and stop its efforts to deport him. Mr. Garces Perez is a 28-year-old DoorDash driver who was shot in the back by an ICE agent in Austin, TX on September 20, 2026. In a letter to DHS Secretary Markwayne Mullin and Acting ICE Director David Venturella, the Members demand that: ICE release Mr. Garces Perez from detention so he can receive medical treatment; ICE abandon efforts to swiftly deport him or remove him from Texas; The ICE agent responsible remain in Texas; and DHS preserve all available evidence related to the shooting and share all evidence with parties that have jurisdiction to conduct a full, independent, and transparent investigation. Rather than receiving medical care, Mr. Garces Perez is being held at "the South Texas Detention Complex in Pearsall, Texas, which has a documented history of medical neglect," the Members write. "According to his lawyers, he still has the bullet lodged in his body. He's received no pain medication and had to sleep on the floor.'" "Mr. Garces Perez is a key witness to this shooting, and given ICE's history of obscuring the facts in similar investigations, he must not be removed," the Members write. The Members demand answers by Monday, September 28th, including: Why did agents use deadly force? ICE's use of force policy requires officers to render medical aid, and video suggests they did not. Why was that policy not followed? What is Mr. Garces Perez's current medical condition? What treatment is he receiving in immigration detention? Will ICE release all bodycam footage? Temporarily Closing Downtown LA Detention Facility, Transferring 22 People to Santa Ana

WATCH: Congressman Gomez reports from outside the B-18 detention facility following today’s inspection LOS ANGELES, CA — An unannounced congressional inspection by Congressman Jimmy Gomez today revealed that ICE is temporarily closing its B-18 detention facility in Downtown Los Angeles and transferring all 22 people currently detained there to a facility in Santa Ana. ICE officials disclosed the planned closure and transfers after Gomez arrived at B-18 without advance notice to inspect conditions inside the facility. Officials told Gomez that the facility is being temporarily closed because ICE expects demonstrations in the area this weekend. The closure and transfers had not been publicly announced before Gomez’s inspection. “The public only knows about this because we showed up unannounced and demanded answers,” said Congressman Gomez. “I sued the Trump administration to protect Congress’s right to conduct these inspections, and I won. ICE cannot operate behind closed doors, and I will keep showing up to hold them accountable.” Today’s disclosure demonstrates the importance of preserving Congress’s authority to conduct unannounced inspections of immigration detention facilities. After the Trump administration attempted to block Members of Congress from entering ICE facilities without advance notice, Gomez personally sued the administration and won, restoring Congress’s ability to conduct surprise oversight visits. Since the Trump administration began its immigration raids in Los Angeles, Gomez has repeatedly confronted ICE and worked to protect the constitutional rights of people in his district. He went directly from the airport to Chinatown during the initial raids and successfully pressed federal agents to leave the area to defuse the situation. Washington, D.C. — Congressman Jimmy Gomez (CA-34) released the following statement after the Supreme Court upheld birthright citizenship and rejected Donald Trump’s attack on the 14th Amendment: “Birthright citizenship isn't a gift from a president. It's a promise in the Constitution itself. “Today, the Supreme Court reaffirmed what the 14th Amendment has guaranteed for more than 150 years: if you are born in the United States, you are a citizen. That promise should never have been up for debate, and the fact that not every justice agreed should alarm every American. “As the proud son of Mexican immigrants, this decision is deeply personal. My parents came to this country with little more than the belief that if they worked hard, their children would have opportunities they never did. My father was a bracero. My mother cleaned homes and cared for seniors. They sacrificed every day so my siblings and I could build a better future. Their story is the story of millions of families who have helped build this country. When Donald Trump began attacking immigrant communities and trying to redefine who counts as an American, I didn't wait to see what would happen. I led more than 200 House Democrats in urging the Supreme Court to reject his unconstitutional attack on birthright citizenship.
